1. Agreement to these Terms

These Terms of Service ("Terms") are a legally binding agreement between you and TRIPSORA CAPITALS LTD ("we", "us", "our"). They govern your use of our websites – https://www.tripsora.com, https://www.routeplanner.ai, https://www.trip-planner.ai and https://www.tripbuilder.ai – and the related applications, tools and services, including the Tripsora AI travel agent and the RoutePlanner.ai route assistant (together, the "Service").

By using the Service you agree to these Terms. If you do not agree, do not use the Service.

Age

The Service is only for people aged 18 or over. By using it you confirm that you are at least 18. The Service is not directed at children, and we ask users to confirm their age before using our AI assistants.

Where the Service is offered

The Service is provided from the United Kingdom. You may not use it if you are located in, or a resident of, a country subject to UK sanctions, or if you are on a UK list of restricted parties. You are responsible for complying with the laws that apply to you.

3. Consumer rights

If you are a Consumer, you have rights under UK law that these Terms do not exclude or limit, including under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 and the UK GDPR. If these Terms conflict with your statutory rights, your statutory rights apply. If any term is found unfair, it does not apply to you, and the rest of these Terms remain in effect.

4. The Tripsora AI travel agent

The Tripsora AI travel agent helps you plan trips in a chat. It can ask you questions to understand your trip, search recent flight fares, suggest hotels and activities with booking links, check the weather for your dates, build a day-by-day plan with a map, and send, share or export that plan.

4A. The RoutePlanner.ai route assistant

The RoutePlanner.ai route assistant plans road trips in a chat. From your start, destination and wishes it chooses stops, calculates the route on roads, splits the drive into driving days with overnight stops, can avoid tolls, motorways or ferries, shows the route on a map, links to hotels at each overnight stop and opens the route in Google Maps. It plans on its own and only asks you a question if it does not know where you are starting or going.

6. Intellectual property

We own or license all intellectual property in the Service, including its design, software, trademarks, content and AI systems. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service and the AI-Generated Content you receive for your own personal travel planning, including sharing your plans with your travel companions. You may not copy, resell or commercially exploit the Service, remove copyright notices or reverse engineer our software or AI systems.

We process personal data under the UK GDPR, the Data Protection Act 2018 and PECR, as described in our Privacy Policy and Cookie Policy. You have rights to access, rectify, erase, restrict, port and object to the processing of your data, and to withdraw consent.

11. API usage

If we give you API access, you may use it only for the purposes we authorise, within published limits, without sharing your credentials, and without replicating or competing with the Service. API access is provided "as is" and may change or end with reasonable notice.

12. AI-generated content

We are not liable for losses caused by relying on AI-Generated Content without verification, or for changes that occur after it was generated. This does not limit liability that cannot be limited by law (section 14).

13. Disclaimers

We provide the Service "as is" and "as available" and do not guarantee that it will always be available, error-free or up to date. For Consumers, this does not affect your rights under the Consumer Rights Act 2015. For business users, we disclaim all warranties to the extent permitted by law.

14. Limitation of liability

15. Indemnification (business users only)

If you use the Service as a business, you indemnify us against claims arising from your breach of these Terms or of third-party rights. This section does not apply to Consumers.

16. Term, termination and changes to the Service

You may stop using the Service at any time and ask us to delete your data. We may suspend or end access for material breaches of these Terms or the law; for Consumers we give reasonable notice unless immediate action is needed for safety or legal reasons. We may change or discontinue features with reasonable notice; for paid products, the remedies in the Digital Product Purchase Agreement apply.

17. Governing law and disputes

These Terms are governed by the laws of England and Wales. Consumers may bring claims in the courts of England or of their country of residence and may use alternative dispute resolution. Business users submit to the English courts. We encourage you to contact us first so we can try to resolve any issue.

18. Changes to these Terms

We may update these Terms to reflect changes in law or in the Service. We will update the date above and, for significant changes affecting Consumers, give at least 30 days' notice by email (if we have your address) or on the Service. If you do not agree, you may stop using the Service before the changes take effect.

19. Miscellaneous

These Terms, together with our Privacy Policy, Cookie Policy, Disclaimer & Affiliate Disclosure and – for paid products – the Digital Product Purchase Agreement, form the entire agreement between us. If a provision is unenforceable, the rest remains in effect. Not enforcing a right is not a waiver. We may assign these Terms to a successor; you may not without our consent. We are not liable for delays caused by events beyond our reasonable control.
